Talc Litigation

Overview

Talc litigation can have a significant impact on a company’s brand reputation, consumer trust and business operations. MG+M The Law Firm helps manufacturers, distributors, suppliers and retailers of consumer and industrial products manage the financial, reputational and regulatory risks associated with talc-related claims, mitigate exposure to liability, and minimize any disruption to business.

Well-known cosmetic and consumer product brands and industrial and pharmaceutical companies trust our team to litigate and manage talc-related claims—including class actions and multidistrict litigation—efficiently and cost-effectively. Our team serves as national coordinating counsel and trial counsel for many cosmetic companies in talc litigation and has effectively reduced overall dockets and obtained defense verdicts in various jursidctions in the United States. We have defended many of our clients in talc litigation from their first lawsuits.

Our experience at trial helps us navigate complex scientific evidence and build proactive defense strategies through trusted experts and investigation. Outside the courtroom, our experience negotiating favorable resolutions and obtaining voluntary dismissals through dispositive motion practice gives us deep insight into the settlement dynamics in this ever-growing mass tort litigation. In addition to talc-related cases, our lawyers are informed by a wealth of experience handling other complex mass tort and toxic tort litigation, including asbestos litigation, as well as products liability matters.

With a deep understanding of the unique challenges of talc litigation, including allegations related to product defects, failure to warn, and potential health risks associated with talc use, MG+M lawyers have a proven track record of protecting the brands we represent.

Experience

  • Serve as national coordinating counsel and trial counsel in talc cases for numerous clients across the United States, including defending many companies from their first lawsuits.

  • Secured defense verdicts, summary judgments, dismissals and otherwise favorable resolutions related to talc litigation and trials, and successfully reduced clients’ overall dockets, in jurisdictions across the United States, including California, Connecticut, Florida, Illinois, Louisiana, Massachusetts, Missouri, New Jersey, New York, North Carolina, Ohio, Oregon, Rhode Island, South Carolina, Texas and Washington. Our clients in these cases have included iconic cosmetic brands, multinational consumer products companies, international talcum powder manufacturers, and direct-sales marketers of beauty and skin care products

  • Secured a unanimous defense verdict for an iconic cosmetic brand and talcum-powder product manufacturer after a highly publicized four-week jury trial, the first cosmetic talc trial to proceed to verdict in Chicago, Illinois.

  • After a four-week jury trial, secured a unanimous defense verdict for an iconic cosmetic brand and talcum-powder product manufacturer in a mesothelioma talc case, the first cosmetic talc trial to proceed to verdict in plaintiff-friendly Portland, Oregon.

  • Won summary judgment for a national client in a mesothelioma case pending in California, by establishing that the plaintiff’s expert’s opinion that our client’s talcum powder contained asbestos amounted to nothing more than rank speculation. We obtained one of the first rulings striking this expert’s opinion. Many other courts followed this ruling, and this expert now rarely testifies in asbestos litigation.

  • Obtained a dismissal for a cosmetic talc supplier in a case where the plaintiff alleged bystander exposure from his wife’s use of a popular cosmetic product brand. Plaintiff aggressively pursued our client with numerous sets of discovery, but due to responses eventually agreed to a voluntary dismissal. There were limited defendants related to cosmetic talc and posed significant risk in a dangerous jurisdiction.
