MG+M The Law Firm Partners Brian Gross and Howard Goldberg, along with environmental consultant and former EPA Regional Administrator Mary Gade, will present a complimentary Perrin Conferences webinar about the recent TSCA PFAS reporting rule and its implications for businesses. The webinar will include an in-depth discussion on the intricacies of the rule, regulatory requirements, compliance deadlines and best practices for compliance.
Background: On September 28, 2023, the US Environmental Protection Agency (EPA) finalized a rule that provides the public with the largest-ever dataset of per- and polyfluoroalkyl substances (PFAS) manufactured in the United States through the Toxic Substances Control Act (TSCA). All entities, regardless of size, that manufactured and/or imported PFAS or PFAS-containing articles since 2011 have until May 8, 2025, to report a panoply of PFAS data. Failure to fully comply and report all reasonably ascertainable information may result in severe penalties and regulatory enforcement actions. This announcement has generated “compliance panic” among the thousands of US companies that manufactured and imported PFAS and PFAS-containing articles of commerce over the past 13 years.
Topics:
- Overview of the TSCA PFAS rule (deadlines, requirements)
- Determination of reporting requirements and the collection of data
- Best practices for complying with the rule and protection of sensitive business information
- Potential challenges and pitfalls to avoid while navigating the process
