Wilmington, Delaware—On Friday, March 25 American Biltrite Inc. secured a defense verdict in Benjamin F. Johnson v. American Biltrite, Inc. MG+M The Law Firm Partners Robert C. Creighton, David J. Fisher and William B. Larson, Jr. served as defense lawyers for American Biltrite. They were supported at trial by Paralegal Supervisor Chris McHale, Manager of Trial Technology Chris Baughman and Trial Paralegal Kitty Fung. The trial was held in-person over a two-week period. This is MG+M’s third consecutive defense verdict in Delaware asbestos cases that it has tried.

In a unanimous decision, the jury of 12 found that Plaintiff Benjamin Johnson was exposed to asbestos from Amtico floor tile, but concluded that such exposure was not a substantial factor in causing his mesothelioma.
“The verdict in this case was based on causation,” said Partner Robert Creighton. “It’s never easy to get 12 people to agree on anything, but the jury based its decision on science and evidence, which clearly demonstrated that our client’s product did not cause Mr. Johnson’s mesothelioma.”
